% 15.05.2017 Having regard to the statement under Section 164 Cr. PC made by the prosecutrix, it cannot be said at this stage that the case is wholly unfounded. It is a matter of probe as to whether the complaint lodged or statement made earlier before the Judicial Magistrate in Punjab was voluntary or under duress. Noticeably, the said proceedings were dismissed in default on 07.02.2017. There is no explanation at this stage as to why such proceedings were not pursued. The allegations made against the siblings in various letters attributed to the prosecutrix are not supported by any material and seem to be non-specific as to the date or time or nature of the incident. In these circumstances, it is not a stage where the petitioner should be granted anticipatory bail.
Dismissed.
