W.P.(CRL) No. 984/2015 and Crl. M.A. No. 7029/2015 (stay) This petition has been filed by one of the accused Rajender Prasad Gautam in view of the settlement arrived at between the complainant (respondent no. 2) and the accused persons before Delhi High Court Mediation and Conciliation Centre on 30th April, 2015. Other accused
persons have not been made as a party.
On the oral prayer made by the proxy counsel for petitioner, all other remaining accused persons are impleaded as respondent nos. 3 to 6. Amended memo of parties be filed during the course of the day.
On the complaint of respondent no. 2, FIR No. 516/2013 under Sections 420/467/468/471/34 IPC was registered at Police Station Janak Puri against the petitioner no. 1 and respondent nos. 3 to 6. Not only the disputes involved in the present FIR but several other criminal and civil cases have been settled. In all, 30 cases are stated to have been settled, which have been detailed in the Settlement Agreement dated 30th April, 2015, photocopy whereof has been placed on record. In the FIR, it was alleged by respondent no. 2 that petitioner and respondent nos. 3 to 6 have forged certain Lease Deeds and other documents. Respondent no. 2 is present in Court and has been identified by SI Vikas Kumar, DIU/West, who is investigating the FIR. Respondent no. 2 submits that she has no objection in case FIR is quashed.
Keeping in mind that respondent no.
the present FIR alive. Accordingly, in the interest of justice, FIR No. 516/2013 under Sections 420/467/468/471/34 IPC registered at Police Station Janak Puri and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
