% 21.07.2015 We have the learned counsel for the parties. Mr Sudhir Nandrajog, the learned senior advocate appearing on behalf of the NHAI, submitted that the subject tender will be cancelled and a fresh advertisement will be issued wherein the petitioners in both these petitions would be permitted to participate subject to them fulfilling the eligibility conditions. He further pointed out that in case the petitioner in W.P.(C) 7190/2014 is removed from the fray on the ground that he submitted two bids, then there would be only one more bidder left and in such eventuality the tender would have to be cancelled By:AMULYA

in any event. Considering this as also the other circumstances and the fact that this matter concerns the appointment of an internal auditor and has been going on for a long time and successive failed attempts have been made at locating the appropriate internal auditor, we feel that it would be best that the present process be cancelled and a fresh notification is taken out within a week.
