The petitioner has invoked the extraordinary jurisdiction of this Court under Article 227 of the Constitution of India praying for issuance of directions to the learned Trial Court to dispose of the applications i.e. application seeking leave to defend filed by the respondent herein on 10th March, 2014 and application under Order 1 Rule 10 CPC filed by applicant Gurcharan Singh on 24th July, 2015, filed in eviction petition bearing ARC No.25293/2016.

On being question as to whether any prayer has been made before the learned Trial Court requesting for expeditious disposal of the two applications mentioned above and if so, the proceedings of that date wherein CM(M) 521/2017

this prayer has been declined by the learned Trial Court, learned counsel for the petitioner could not show any such request being made and declined by the learned Trial Court.

The petition is dismissed granting liberty to the petitioner to approach the learned Trial Court for early disposal of the pending applications filed in eviction petition bearing ARC No.25293/2016.
