CORAM:

HON'BLE MR. JUSTICE A. K. CHAWLA

O R D E R

% 04.07.2017 Petitioner is a contractor, who has undertaken to run Metro Feeder Buses to ply from various Metro Stations under an arrangement with Delhi Metro Rail Corporation (DMRC) on compliance of the requirements under the Motor Vehicle Act and the

allied provisions. Pre-dominant prayer in the petition is as follows : "Issue Writ or order in the nature of Mandamus declaring the list dated 02.02.2015 of metro link routes for metro feeder buses furnished by the Respondent No.2 (STA) before the Court of Ms. Mayuri Singh, MM, Karkardooma Courts, Delhi as effective and permitted as on date and allow the Petitioner herein to ply their vehicles as per the said list." It is not in dispute that the petitioner is running such feeder buses as approved by DMRC and the permits have come to be granted by STA-respondent no.2 for the individual vehicles to be run on diverse routes in the name of DMRC, being the permit holder. Mr. Aggarwal, ld. Counsel for the respondent no.1 on his part contends that though the permits also provide for permission to operate on other metro feeder routes than what find mention in the respective permits, if, any vehicle is to ply on any route, which does not find specific mention in the permit, the permission for that has to be obtained from STA, separately.

Having said so, Mr. Aggarwal, on instructions, submits that as per the list dated 2.2.2015 of metro link routes for metro feeder buses furnished by STA-respondent no.2 before the Court of Ms. Mayuri Singh, ld. MM, it remains effective even as of today and thereby, the petitioners are allowed to ply their vehicles as per the said list, even as of now. When that is so, nothing

survives in the petition.

Petition and the pending applications are disposed off accordingly.

It however, goes without saying that in the event of any violation, the concerned authorities would be at liberty to initiate such action(s) as may be permissible under law. Dasti.
