Mr. Prashant Kumar, Law Officer, Prisons is present in Court. He expresses his regret for non-filing of the report by DG, Prisons. He states that action pursuant to order passed by this Court on 24th January, 2018 has been taken however, inadvertently the report could not be filed. He states that in future no non-compliance of the order of this Court will take place. He further states that fresh nominal roll of Dinesh Kumar Sahani has been sent to this Court. As per the nominal roll the appellant has undergone imprisonment for one year and twenty days during the course of trial before he was acquitted by the learned Trial Court.

Vide a separate judgment passed in Court today, the appeal filed by the State is disposed of setting aside the impugned judgment of acquittal of respondent Dinesh Kumar Sahani for offence punishable under Section CRL.A. 466/2017
308/34 IPC, convicting him for the said offence and directing him to be released on the period already undergone.
