% 18.11.2016 Petitioner seeks furlough in terms of the Parole/Furlough Guidelines, 2010.
Learned Standing Counsel has opposed grant of furlough. It is submitted that furlough is granted to a convict, who is maintaining good conduct and is not a habitual offender. Reliance has been placed on Clause 26 of the Parole/Furlough Guidelines, 2010. Learned counsel for the State submits that petitioner is a habitual offender and he is involved in twelve criminal cases, out of which he has been convicted in seven cases and acquitted in three cases.
It is further submitted that petitioner did not surrender despite dismissal of the appeal on 1st September, 2009. He was
arrested after about three years on 18th July, 2012. Keeping in mind the totality of facts and circumstances, petitioner has failed to make out a ground for his release on furlough. Writ petition is dismissed.
