+ CRL.M.C. 2423/2017 SARABJIT SINGH CHANDHOK & ORS ..... Petitioners Through:

Petitioners in person.

versus STATE & ORS ..... Respondents Through:

Mr. M.S. Oberoi, APP for State with SI Surender Kumar of police station Hari Nagar.

Ms. Fizani Husain, Adv. for R-3 along with R-3 in person.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 14.12.2017 It is submitted that petitioner no.1 and respondent no. 3 have resolved their differences and started living together since May, 2017, therefore, FIR No. 253/2013 under Sections 498A/406/34 IPC registered at police station Hari Nagar may be quashed.

Respondent no. 3 is present in Court along with her counsel and has been identified by SI Surender Kumar of police station Hari Nagar. She submits that she is living with her husband, that is, petitioner no.1 happily, therefore, she is not interested in pursuing the aforesaid FIR any further and the same may be quashed against all the petitioners. Keeping in mind that husband (petitioner no.1) and wife (respondent no.2) have started living together after ironing out their differences and

respondent no.2 does not wish to pursue the FIR any further, in my view, no fruitful purpose would be served in keeping the present criminal proceedings pending.

Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.

Dasti.
