O R D E R

% 09.09.2016 The present is a petition under Article 226 read with Article 21 of the Constitution of India, praying, inter alia, as follows: " Issue writ in the nature of mandamus or any other appropriate writ, order or direction thereby directing the respondent no.2 to pay/release the funds/amount lying in the bank Account No.0268101063792 of Dr.Abha Chaudhary to the respondent no.3 hospital for meeting out the expenses of medical bills and other treatment of Dr. Abha Chaudhary, who is bed ridden and in the stage of coma."

Mr V.K.Tandon, learned counsel appearing on advance notice on behalf of Canara Bank (respondent No.2) , states that in view of the facts and circumstances of the case and the urgency explicit therein, in the event that a representation seeking the relief sought in the present petition, is made to the bank (respondent No.2), the same shall be

determined by the bank, forthwith, expeditiously. Directed accordingly.

In view of the foregoing, learned counsel appearing on behalf of the petitioner seeks leave to withdraw this petition with liberty to approach Canara Bank (respondent No.2) in this behalf, in the first instance.

Leave and liberty granted.

The petition is dismissed as withdrawn and disposed of accordingly.

The application stands disposed of.

Copy of the order be given dasti to the counsel for the parties under signatures of the Court Master.
