Appellant insurance company has filed an appeal for reduction of the award dated 02.09.2014 passed by the Learned MACT, awarding a compensation of Rs.45,92,470/- along with interest @ 9% p.a. from the date of filing of claim petition. On appeal, the insurance company deposited 60% of the awarded amount with up to date interest in terms of the order dated 09.01.2015 passed by this Hon'ble Court before the tribunal and 60% of the awarded amount was directed to be released.

Appeal for enhancement bearing MACA 278/2016 filed by the claimant against the same award was settled with the insurance company agreed to pay Rs.2,00,000/- over and above the awarded amount. In view of the said settlement, the Officer of the appellant company has instruction to The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. withdraw the appeal.

In view of the above settlement, the insurance company is directed to deposit 40% of the principal awarded amount i.e. Rs.18,36,987.80/- along with interest 9% w.e.f. the date of filing of the claim petition i.e. 12.01.2012 till the date of deposit, before the concerned tribunal within a period of 06 weeks from today failing which it shall carry interest at the rate of 9% per annum on the delayed deposit. The said amount be released to the respondent(s)/claimant in terms of the award of the tribunal. 4.
Statutory amount with along with interest, if any, may also be refunded to the Insurance Company.
