% 06.09.2017 It is submitted that petitioner and respondent no. 2 have settled their disputes amicably; therefore, offence under Section 138 of the Negotiable Instruments Act, 1881 ("the Act", for short) against the petitioner may be compounded. Petitioner has paid `3,30,000/- to the respondent no. 2 towards full and final settlement of the amount involved in the cheque in question, vide two demand drafts. Photocopies whereof have been placed on record. Respondent no. 2 is present in Court along with his counsel and says that he has no objection in case offence under Section 138 of the Act is
compounded.
In view of the settlement arrived at between the petitioner and respondent no. 2, offence under Section 138 of the Act is compounded and petitioner is acquitted.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
