After arguments, this appeal is disposed of with the consent order that the impugned judgment dated 15.2.2017 is set aside and unconditional leave to defend is granted to the appellant/defendant but the appellant/defendant will not get more than three opportunities to complete his evidence and the trial court is requested to complete hearing of the final arguments preferably within four months of completion of evidence. 2.

As agreed, written statement will be positively filed by the appellant on the very first day when the matter is listed before the concerned competent court to which the suit is marked by the District and Sessions Judge.

Parties to appear before the District and Sessions Judge, South West District, Dwarka Courts, New Delhi on 13th August, 2018 and the District and Sessions Judge will now mark the suit for disposal to a competent court RFA 496/2017

in accordance with law.
