Learned counsel appearing for the appellant submits that the present appeal has become infructuous.

It is pointed out that the present appeal was filed assailing the impugned order dated 10.04.2017 passed by the learned Commissioner, Employees' Compensation, primarily challenging that the learned Commissioner had no power to direct a part of the compensation to be deposited in a fixed deposit and thereby denying the claimants the financial benefits that have been accrued to him by virtue of the award passed in his favour. It is submitted that the entire amount has been released in favour of the appellant since the FD was only for five years.

In view thereof, the present appeal is dismissed as withdrawn. DHARMESH SHARMA, J.
