BAIL APPLN. 863/2017 The petitioner seeks bail in connection with FIR No.228/2016 dated 04.06.2016 (P.S. Mayur Vihar-I) instituted for offences under Section 20 (b) (ii) of the NDPS Act.
The petitioner is said to have been found in possession of 2 Kgs of ganja in contravention of the provisions of Section 20 (b) (ii) of the NDPS Act.
Taking into account the quantity of ganja recovered from the possession of the petitioner which is little more than the minimum quantity, this court is inclined to release the petitioner on bail.
The petitioner is directed to be released on bail on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Trial Court.
Should the petitioner be found trafficking in narcotics again, it would be open for the State to file an application for the cancellation of his bail. The petition is disposed of.
