CORAM:

HON'BLE MS. JUSTICE PRATIBHA RANI

O R D E R

% 08.05.2017 TR.P.(C.) 80/2017 1.

This transfer petition has been filed by the petitioner who is wife of the respondent with the prayer that the Divorce Petition bearing No.795/2016 of Hindu Marriage Act titled 'Kamal Kaushiv Vs. Manju', filed by the respondent herein and pending in the Court of Principal Judge, Family Court, Dwarka, Delhi be shifted to the Principal Judge, Family Court, Tis Hazari, Delhi.

2.

Learned counsel for the petitioner submits that the petitioner is finding it difficult to visit Dwarka Courts as she has a young child aged 17 months and she has to take the child along with her on each and every hearing.

3.

Perusal of the memo of parties shows that the address of the petitioner is of Nangloi, New Delhi and that of the respondent is of Uttam Nagar, New TR.P.(C.) 80/2017

Delhi. Distance wise, Family Court, Dwarka, Delhi may be more convenient to the petitioner than the Family Court, Tis Hazari, Delhi. 4.

In any case, inconvenience faced by the petitioner by attending the Family Court, Dwarka, Delhi cannot be reduced by transferring this petition to Family Court, Tis Hazari, Delhi which is also far away from her place of residence in Nangloi.

5.

Thus, I do not find any sufficient ground to transfer the matter from Principal Judge, Family Court, Dwarka, Delhi to Principal Judge, Family Court, Tis Hazari, Delhi.

6.

The petition is hereby dismissed.

CM No.17512/2017 (stay) Dismissed as infructuous.
