Petitioner is facing trial for commission of offences under Sections 376/377/313/323/342/406 and 506 IPC.

Charges were framed on 02.08.2016 and the case is pending adjudication before the learned Trial Court.

The present petition seeks quashing of charges, particularly, for offence under Section 376 IPC.

The complaint in question was lodged by the prosecutrix, stated to be the wife of the petitioner, way back in the year 2013. 5.
After hearing arguments for some time, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present petition.

He, however, prays that a request be made to the learned Trial Court to expedite the trial and to conclude the same in a time-bound manner as the matter has already got delayed considerably.

Learned APP for the state submits that there would be no inaction or delay on their part.

Learned counsel for prosecutrix, who has joined the proceedings through video conferencing, also assures that the prosecutrix would also appear as and when so directed to ensure that the trial is concluded without any further delay.

The next date before the learned Trial Court is stated to be 06.03.2026. 10.
In view of the above, the present petition is disposed of as not pressed. 11.
All rights and contentions of the parties are, however, reserved. 12.
Learned Trial Court is also requested to make best endeavour to conclude the trial within a period of six months from the date it takes up the matter on 06.03.2026.

Needles to say, both the sides would render best co-operation and assistance to the learned Trial Court.

In case the trial is not concluded within the abovesaid stipulated time frame, learned Trial Court would send report, citing the reasons thereof. 15.
The petitioner would also be, in such eventuality, at liberty to get the present proceeding revived.
