Learned counsel for the parties submit that pursuant to an order dated 16.11.2023 passed by the learned Executing Court, the possession of the subject premises has already been handed over/ taken over by the respondent.

As such relying upon N.C. Daga vs. Inder Mohan Singh Rana [2003(1) SCC 453] and Vinod Kumar Verma vs. Manmohan Verma & Anr. [Civil Appeal Nos.5220-5221 of 2008, order dated 19.08.2008], the present petition has become infructuous as there is nothing remaining therein.
