% 08.03.2019 Quashing of FIR No.
1395/2015, under Sections 420/406/468/120B of IPC, registered at Police Station Janak Puri, New Delhi is sought on merits.
Mr. M.S.Oberoi, Additional Public Prosecutor for respondent-State informs that charge-sheet in this case has been filed and the case is coming up for hearing before the trial court on the point of charge. Since petitioner has an alternate and efficacious remedy to urge the pleas taken herein before the trial court at the charge stage, therefore, this Court is not inclined to invoke its extra ordinary inherent jurisdiction under Section 482 of Cr.P.C.
Accordingly, while refraining to comment upon the merits, this CRL.M.C. 2041/2017
petition and the application are disposed of, with liberty to petitioner to urge the pleas taken herein before the trial court at the charge stage. (SUNIL GAUR) JUDGE MARCH 08, 2019 v CRL.M.C. 2041/2017
