% 03.11.2017 Respondent no. 2 Shri Kulwant Rai Goyal is present along with his counsel.

Respondent no. 2 says that he has settled the matter with the petitioners before the Delhi Mediation Centre, Tis Hazari Courts on 28th July, 2016 of his own free will, voluntarily and without any undue force, pressure or coercion. He submits that Compromise Deed/Agreement dated 28th July, 2016 was also signed by the parties and is part of the mediation/settlement proceedings.

Respondent no. 2 also admits his signatures on his affidavit at pages 47 and 48. In his affidavit also,

respondent no. 2 had stated that he has compromised the matter with all the petitioners with his own sweet will and accord without any pressure, coercion or threat from any corner. He supports the petitioners for quashing of the impugned order passed by the Metropolitan Magistrate. By the order dated 30th April, 2016, learned Metropolitan Magistrate has ordered for summoning of the petitioners in the Complaint Case no.4/1/15 titled Kulwant Rai Goel vs. State & Ors. In view of the compromise, impugned order is set aside and the complaint case is quashed. Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
