This petition is filed under section 9 of the Arbitration and Conciliation Act, 1996 seeking interim orders against the respondent. This Court on 23.5.2017 had passed interim orders restraining the respondent from selling, alienating or transferring the property being B-II/46, Mohan Co-operative Industrial Estate, New Delhi to any third party, till further orders.

Today, I have appointed a Sole Arbitrator in Arb.P.325/2017 to adjudicate the dispute between the parties. Accordingly, as agreed by learned counsel for the parties the petitioner will file an application under section 17 of the Arbitration and Conciliation Act before the learned Arbitrator within six weeks of the learned Arbitrator entering appearance. The interim order passed by this Court on 23.5.2017 shall continue to operate until it is confirmed or vacated or modified or varied by the learned

Arbitrator, in accordance with law.

Liberty is also granted to the respondent to move an appropriate application in this regard before the learned Arbitrator. This order is passed without prejudice to the rights and contentions of the parties. 4.

Petition stands disposed of. All pending applications, if any, also stand disposed of.
