% 28.08.2018 Crl.M.A.No.30863/2018 Allowed subject to just exceptions.
W.P.(Crl.) No.2539/2018 1.
By this petition, petitioner seeks quashing of FIR No.233/2018 under Section 304A IPC registered at PS Govind Puir and the proceedings pursuant thereto resulting in the death of Pintu Yadav. 2.
Learned Additional Standing Counsel for the State submits that the petitioner is the only accused and respondent No.2, the wife of the deceased Pintu Yadav and respondent No.3 the father of Pintu Yadav are the complainants.
3.
The deceased Pintu Yadav is survived by his wife, two children and the mother besides the father. All legal heirs have not been impleaded. W.P.(CRL) 2539/2018
4.
Learned ASC for the State also submits that the compensation so settled with the family of deceased is too meagre and not as per the victim compensation scheme.
5.
In view of the facts noted above, this Court finds no ground to quash the FIR in question on the basis of settlement. However the family of the victim Pintu Yadav is directed to approach the Delhi Legal Services Authority for the victim compensation which will process the case and award interim as well as final compensation.
6.
Petition is dismissed.
7.
Order dasti.
