The learned counsel for the respondent states that the petitioner has been allotted a flat in R.K. Puram, New Delhi and, therefore, the petitioner's grievance stands addressed. Ms Zubeda Begum, learned counsel appearing for the petitioner submits that the petitioner has an ailing father, aged about 93 years and, therefore, it is very difficult for petitioner's father to access the flat that has been allotted as the same is on the third floor. She submits that the respondent may consider the petitioner's request for a flat on a lower floor on compassionate ground.

In view of the above, the respondent is directed to consider the petitioner's case on compassionate ground in conformity with its policy. However, it is clarified that if the respondent is not able to provide a flat on a lower floor, the petitioner would have to make a choice between accepting the flat in the area of his choice (that is, R.K. Puram) or shifting to another locality, where the respondent may be in position to provide a flat on the

lower floor.

It is also clarified that if the petitioner is entitled to shifting allowance, the same would not be withheld by the respondent. 4.

The petition and the pending application are disposed of with the aforesaid directions.
