% 10.10.2018 It is submitted that petitioner No. 1 (husband) and respondent No. 2 (wife) are living together after settling their dispute amicably. Respondent No. 2 is present in Court and has been identified by SI Kuldeep Kadyan, Police Station - Bharat Nagar.
Respondent No. 2 submits that she is living with petitioner No.1 voluntarily and without any undue force, pressure or coercion and she has no objection if the FIR No. 463/16, registered at Police Station - Bharat Nagar, under Sections 498A/406/34 IPC is quashed against the petitioner Nos. 1 and his relatives i.e. petitioner Nos. 2 to 6 Affidavit of respondent No. 2 is also on record to this effect.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, I am of the view that no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 463/16, registered at Police Station - Bharat Nagar, under Sections 498/406/34 IPC and consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
