% 13.07.2016 The present petition has been filed seeking quashing of the order dated 09.04.2015 on the ground that the court vide the said order struck down the defence of the petitioner which the court was not empowered to do.

During the course of arguments, the order dated 09.04.2015 was perused in the court and the operative portion of the same reads as under:

"The respondent is again directed to clear complete arrears of interim maintenance within four weeks failing which respondent shall address as to why the defence be not struck off."

Thereafter, the matter was adjourned to 30.05.2015. Immediately thereafter, the present petition was filed on 11.05.2015 without making the payment of arrears of interim maintenance. Apparently, the order dated 09.04.2015 is in the nature of a show cause notice directing the petitioner-herein to address the court as to why his defence be not closed if he fails to clear the arrears of maintenance within four weeks.

The present petition is premature as it does not give any cause to the petitioner to challenge the order dated 09.04.2015. Dismissed.
