O R D E R
% 19.03.2019 The present petition has been filed under Section 438 of Cr.P.C for grant of anticipatory bail on behalf of the applicant/petitioner in FIR No. 730/2017 under Section 420/384/506/34 IPC registered at PS Seelampur, Delhi.
Learned counsel for the petitioner contended that the present FIR has been lodged pursuant to property dispute between the relatives of the petitioner and suits are pending consideration before the Hon'ble Courts. He further submitted that trial court has granted interim protection which was continued by this Court vide order dated 04.09.2018. Learned counsel for the petitioner submits that the petitioner will join investigation as and when required by the investigating officer without default. Learned counsel for the State submits that no settlement have been arrived at between the parties and the mediation proceedings have come to an end as 'Non-Settlement'. He further submits that the petitioner alongwith her husband Puran Chand had cheated the complainant and has sold out
some portion of the property which she was not the owner. From the perusal of the record, it transpires that certain civil proceedings are pending adjudication between the parties. She has been granted interim protection by the trial Court as well as by this Court and she has been cooperating in the Investigation.
Keeping in view the facts and circumstances of the case, it is hereby directed that in the event of arrest till filing of the chargesheet, the petitioner, Urmila Devi be released on bail on the following terms and conditions:- (i) That the petitioner shall furnish a personal bond in the sum of Rs.25,000/- with one surety of the like amount subject the satisfaction of Arresting Officer/SHO concerned;
(ii) That the petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required;
In case of default of aforementioned condition, the State is at liberty to take appropriate recourse in accordance with law. Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case. Application stands disposed of.
