W.P. (Crl.) 2659/2016 Present FIR was registered against the petitioner at police station Tilak Nagar under Sections 279/337 IPC, on the complaint of respondent no.2.

Respondent no. 2 has alleged in the FIR that he along with respondent nos. 3 and 4 was going in his car bearing registration no. DL4C AN 6825, and when they reached at the crossing of Najafgarh Road petitioner, while driving his car bearing registration no. DL 12CE 9415 at a fast speed, hit his car, as a result whereof respondent nos. 3 and 4 sustained injuries. Learned Standing Counsel for the State submits that injury of

respondent no. 3 has been opined as grievous by the doctor, accordingly, Section 388 IPC has been added in the FIR.

He further submits that investigations are at preliminary stage.

Petitioner and respondent nos. 2 to 4 have settled their disputes amicably vide Memorandum of Understanding dated 4th September, 2016 with the intervention of their common friends. Respondent nos. 2 to 4 are present in Court and have been identified by the Investigating Officer. Respondent nos. 2 to 4 submit that they have settled the matter with the petitioner and do not wish to pursue the FIR any further. Keeping in mind the above facts and the fact that a settlement has been arrived at between the parties during the investigations itself, in the interest of justice, FIR No. 637/16 under Sections 279/337/338 IPC registered at police station Tilak Nagar is quashed, subject to, however, petitioner depositing costs of `25,000/- with the Delhi High Court Bar Association Lawyers' Social Security & Welfare Fund, New Delhi within one week. Receipt be handed over to the Investigating Officer. Writ petition is disposed of in the above terms. Copy of the order be given dasti under the signatures of Court Master. A.K. PATHAK, J.
