TR.P.(C.) 164/2018 Vide the present petition, the petitioner seeks the transfer of guardianship petition GP No.12/17 pending before the Court of the District Judge (West) to the Court of the Additional District Judge-01 (West) submitting to the effect that the petitioner No.1 seeks to sell out the joint property in view of the GP No.12/17 for protection of the interest of the minor children arrayed as Petitioners No. 2 and 3 submitting inter alia to the effect that the proceedings have not commenced for a year and the petition has also not been admitted for hearing.
On behalf of the respondent, there is no opposition to the prayer made by the petitioner.
Apparently, there is no incumbent to the post of District & Sessions Judge (West) w.e.f. 1.11.2017 on retirement of the previous incumbent to the post of the District & Sessions Judge (west). As the proceedings in relation to the Guardianship qua the property of minors falls within the domain of the District Judge, the proceedings of the guardianship petition GP No.12/17 are withdrawn from the Court of the District & Sessions Judge (West) and assigned to the Court of the District & Sessions Judge, Central, Tis Hazari Courts to proceed further in accordance with law where the parties are directed to appear on the date 17.9.2018 at 2;30 p.m. where the records of the guardianship petition GP No.12/17 be placed.
