Learned APP for State has accepted notice and has pointed out that the petitioner has filed the present petition seeking quashing of FIR but as per memo of parties, the co-accused has not been impleaded as a party/petitioner. Learned APP for the State seeks time to file status report. At this stage, learned counsel for the petitioner submits that he shall implead the co-accused as a party/petitioner and prays that he be permitted to withdraw the present petition with liberty to file fresh petition. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with liberty to file fresh
petition, if desires, as per law.
