% 28.02.2020 C.M. No.8124/2020 (by the appellant for clarification/modification of the order dated 15.1.2020) 1.

This application has been moved by the appellant praying inter alia for clarification/modification of the order dated 15.1.2020, whereby the appeal was disposed of on passing an open court order in the presence of the parties.

Learned counsel for the appellant seeks to refer to para 10 of the order dated 15.1.2020 to state that what has been recorded in the said para is erroneous and in support of the said submission, he seeks to rely on certain documents filed alongwith the application at page 38 of the application. 3.

On enquiring from learned counsel for the appellant as to whether any such document was made a part of the appeal paper book, he concedes it was not. Admittedly the said document was not even referred to in the course of arguments addressed on 15.1.2020.
