W.P.(CRL) 1005/2015 During the assembly elections of 2015 respondent nos. 2 to 6 were supporters of Congress party; whereas petitioners were supporters of B.S.P. A quarrel took place between the petitioners and respondent nos. 2 to 6

wherein, petitioners gave beating to respondent nos. 2 and 4, resulting in simple injuries to them. Incident led to registration of FIR No. 120/2015 under Sections 323/341/506/34 IPC read with Section 3(1)(X) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station Govind Puri.

During the investigation, petitioners and private respondents have settled their disputes amicably on the terms and conditions as stipulated in the Memorandum of Understanding dated 5th May, 2015. Keeping in mind that quarrel erupted on some trivial matter during the assembly elections and now parties have settled their disputes amicably in order to maintain harmonious relation being known to each other, no fruitful purpose would be served to keep the FIR alive. Accordingly, in the interest of justice, FIR No. 120/2015 under Sections 323/341/506/34 IPC read with Section 3(1)(X) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered at Police Station Govind Puri and the consequent proceedings emanating therefrom are quashed, subject to, however, costs of `25,000/- to be deposited by each of the petitioners with the Bar Council of Delhi Advocates Welfare Fund within four weeks.
