CORAM:

HON'BLE MR. JUSTICE JAYANT NATH

O R D E R

% 11.01.2017 On 22.05.2015 notice was issued limited to the prayer of the petitioner for expeditious disposal of the suit. Learned counsel for the petitioner has pointed out that the suit was filed in 1975. A consent preliminary decree was passed in 1989. The local commissioner appointed to suggest the mode of partition by metes and bounds gave his report in 1994. The suit is still lingering on. He submits that one application after the other was being filed which prolonged the suit. In the interest of justice and keeping in view the fact that the suit is is of 1975, the trial court is requested to expeditiously dispose of the suit. If possible, the suit may be heard on day to day basis. No adjournment shall be

granted to any party except on emergent reasons. The suit may preferably be disposed of within six months from today.

With the above observations, the petition stands disposed of. All pending applications also stand dispose of. JAYANT NATH, J JANUARY 11, 2017 rb
