% 05.02.2016 After brief submissions, learned counsel for the appellant very fairly states that he does not press the present appeal. I have perused the order dated 24.12.2014. The learned First Appellate Court has set aside the order passed by learned Civil Judge on 18.02.2013, dismissing the suit of the respondent No.2 on preliminary objection, which has been set aside by the learned senior Civil Judge on 24.12.2014 and the matter has been remanded back to the trial court to be decided in accordance with law. It is expected that the learned Civil Judge will dispose of the matter after framing of issues in accordance with law, as
expeditiously as possible.
Record of the trial court be transmitted back. V.K. SHALI, J FEBRUARY 05, 2016 / n
