O R D E R

% 23.05.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner for grant of interim bail in case FIR No.497/2012, under Sections 147/148/149/302/307/325/342/365/368/395/397/449/450/452/201/412/120B/34 and under Sections 25/27/30 Arms Act, Police Station-Mehrauli, Delhi.

Counsel for the petitioner has submitted that petitioner's elder daughter is studying in a boarding school in Dehradun and the petitioner is unable to afford his daughter's education in the said school. He further submits that the petitioner wants to shift his elder daughter to Noida where his wife and younger daughter are already residing. He further submits that the petitioner has applied in several schools for his elder daughter's

admission in class 9 and prays that the petitioner be granted interim bail for one month to get his child's admission in a school at Noida. On the other hand, learned APP for the State has vehemently opposed the bail application and has submitted that the allegations levelled against the petitioner are very serious in nature. Status report has been filed on behalf of the State. Learned APP for State has further submitted that the bail application of one of the co-accused on similar grounds has already been rejected by the Court. Learned APP for State has further submitted that the petitioner has given details of four schools where he intends to get admission of his child. The admission form of JBM Global School sent for verification reveals that although application form was collected on 03.04.

2017 but the form was not deposited for further process and now there is no vacancy in class IX. The application form of S.S. Public School sent for verification reveals that the said school is recognized only upto class VIII and no application form has been sold for admission in class IX by the school authorities. The application form of Khaitan Public School does not bear any date or receiving form of the concerned school and is mere a handwritten application, thus it could not be verified. The application form of Amity International School filed by the petitioner is sent for verification which reveals that the same is not an application form and is merely an enquiry form and that no application in the name of daughter of the petitioner has been deposited in the school for admission.

A perusal of the status report reveals that on verification, the list of schools given by the petitioner for his daughter's admission is contradictory.

for admission of his child. Further, the allegations alleged against the petitioner are very serious in nature. Accordingly, I do not find it a fit case to grant interim bail to the petitioner. Consequently the present bail application is dismissed.
