CRL.M.C. 1948/2017 By the petition filed, the applicant seeks directions for early disposal of an application filed by the petitioner under Section 340 read with Section 195(1)(b) of Cr.P.C.

During the course of hearing, it transpires that the petitioner has filed a complaint under Section 200 Cr.P.C. for the alleged commission of offences for forgery, fabrication etc. and during the course of hearing thereof, the petitioner filed a revision and during that course, some affidavit came to be filed. On the premise of such affidavit filed before the Revisional Court, the petitioner filed an

application under Section 340 Cr.P.C.

On being queried, ld. Counsel for the petitioner submits that the original complaint proceedings filed by the petitioner under Section 200 Cr.P.C. for the alleged commission of offences for forgery, fabrication of documents etc. have come to be stayed by the High Court.

The instant petition however, does not divulge any of such information, which, I consider, was necessary. Even no copy of the complaint is filed.

Suffice to say, the directions sought cannot be issued in a mechanical manner. Petition is therefore, rejected with the liberty reserved to the petitioner to file a fresh, if, so desired, furnishing requisite information/particulars, relevant to the subject. ANIL KUMAR CHAWLA, J MAY 15, 2017 rc
