O R D E R
% 19.07.2016 Petitioner is aggrieved by the communication dated 27.11.2013 vide which his application for alternative plot has been rejected. This was largely on the premise that the requisite documents sought from the petitioner have not been furnished by him. Record shows that Meer Singh who was the original owner of the land in question had died on 31.3.2006. He had, however, applied for an alternative plot on 14.02.1994 i.e. during his lifetime. This was pursuant to the acquisition of his land which was acquired by an Award No.6-B/Supl./1981-82 dated 29.9.1983. His further submission is that Meer Singh in his lifetime had furnished the documents to the Department on 25.02.1994.
Contention of the Department is that on 10.01.2013 they had addressed a letter to the petitioner reminding him of his default in not submitting the requisite documents.
Prior to this also communications had been addressed by the Department to the petitioner which are dated 06.3.2000, 11.7.2000, 05.3.2002. Contention of the petitioner is that these communications were not received by him as they had been sent at 9 Jungpura, Bhogal whereas his address is 9 Jungpura Road, Bhogal. The word "Road" having been omitted, these letters were not received by him. Further contention of the petitioner is that all his documents are now ready and his prayer is that they may be considered in accordance with law.
Petitioner will submit all his documents before the competent Authority within one week. The respondent/competent Authority will consider these documents within an outer limit of two weeks from today and the case of the petitioner shall be furnished processed in accordance with law by the respondent.
Petition disposed of.
