% 29.08.2018 The petitioner‟s applications for bail were withdrawn on 06.02.2018 and 12.07.2018, on the ground that the testimony of material witnesses were yet to be recorded on a subsequent date. The Court had noted the submission of the learned Additional Public Prosecutor for the State that every endeavour would be made to have the evidence of the said witnesses recorded, before the next date, i.e. 30th July, 2018. The Court would note that instead of the State having requested for a recording of the evidence, the case has now been listed after 3 months 20 days later, i.e., to 20th November, 2018.

The petitioner has been incarcerated for almost 14 months. In view of the above, the respondent shall move an application for preponement of the date of recording of evidence to sometime in the month of September, 2018 and request for the completion of the same by the end of

October, 2018. Liberty granted.

In the circumstances, the petitioner does not press the relief sought in this petition. Accordingly, it is dismissed as withdrawn. A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master. NAJMI WAZIRI, J AUGUST 29, 2018 RW
