The present petition has been filed by the petitioner for a direction to the respondent Bank to consider 1198 days leave without pay for the purpose of terminal/retiral dues.

The only submission made by Mr. Mishra is that the representation dated April 9, 2017 (page 13) be considered and disposed of by the

respondent with a speaking order. Additionally he states that in identical facts with respect to one employee Mr. K.K. Nigam, a Memorandum of Settlement has been entered between the respondent Bank and Mr. Nigam, wherein according to Mr. Mishra, the period of absence from duties in similar circumstances was reckoned for the purpose of superannuation benefits as a special case.

Noting the only submission made by Mr. Mishra, I deem it appropriate to direct the respondent to dispose of the representation dated April 9, 2017 taking into consideration the Memorandum of Settlement entered between the respondent Bank and Mr. K.K. Nigam by passing a reasoned order within a period of eight weeks. The writ petition is disposed of as such.
