% 26.05.2017 Mr. Sahoo, after some hearing wishes to withdraw this petition as the petition raises disputed question of fact, which cannot be decided in proceedings under article 226 of the Constitution of India. The dispute is primarily between three brothers.

We are constrained to notice that Mr. Sahoo had appeared for one of the brothers of the petitioners in W.P.(C). 4430/2014 and how and why, the learned counsel has decided to appear for another brother is rather surprising. The petition stands dismissed as withdrawn.
