% 27.01.2016 While disposing of CM(M) 1074/2014 and endorsing the order passed by the learned Civil Judge dismissing the application of the petitioner Himadri Shekhar Tyagi under Order I Rule 10 of the CPC this Court notes that since the Court had already arrived at a finding that the present petitioner is not a necessary party to the suit, the impugned order dismissing the order under Section 151 of the CPC suffers from no infirmity. Petitioner was not a party before the Civil Court and as such Trial Court has rightly not passed any order. Dismissed.
