% 14.09.2016 Learned counsel appearing for respondent No.2 submits that since there was no clarity on the functioning of the College Complaints Committee, the two members of the College Complaints Committee had handed over all the records to the respondent No.1 - College.

Learned counsel appearing for respondent No.1 - College submits that the record has been received, however there is no receipt of the report of the College Complaints Committee and as such, no action could be taken.

Learned counsel for respondent No.3 - University submits that in view of the notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, the complaints with regard to sexual harassment has to be dealt with in WP(C) 6369/2015

accordance with the said Act. She further submits that the University has given a clarification that complaints of sexual harassment received prior to the notification of the said Act are to be governed under the old procedure under the University Ordinance XV-D. In view of the submission of the University, the respondent - College is directed to provide clarity on the College Complaints Committee and in case any re-constitution of the said Committee is required, the respondent - College shall re-constitute the same within a period of eight weeks from today.

The College Complaints Committee shall consider the report of the Sub-Committee already furnished to the respondent - College in accordance with law and expeditiously dispose of the complaint filed by the petitioner. The decision of the College Complaints Committee be communication to the petitioner.

The writ petition is accordingly disposed of in the above terms. SANJEEV SACHDEVA, J SEPTEMBER 14, 2016 'sn'
