W.P.(C) 8269/2016 and CM No. 34264/2016 Petitioner is aggrieved by the order passed by the Public Grievances Cell dated 26.07.2016. By this order the public Grievances Cell had directed the Assistant Engineer, Central Zone, SDMC to identify the encroachment and take action against the property no. 719, Village Mahila Mohalla, Madanpur Khadar, near Sarita Vihar, New Delhi in accordance with law. It had listed the matter before itself for 19.09.2016 for compliance. Petitioner is aggrieved by the order. His submission is that the
Public Grievances Cell is not a statutory body; the Public Grievances Cell was aware of the fact that the demolition order passed by the SDMC dated (26.08.2015) is the subject matter of an appeal before ATMCD and Public Grievances Cell in its order itself has noted that the next date fixed before the ATMCD is 14.09.2016. The order dated 26.08.2015 had been stayed on 13.05.2016. It had yet gone on to pass this order which would be against the order of the ATMCD. Counsel for the respondent Corporation submits that the matter is fixed before the Public Grievances Cell today and this fact had to be informed to the Public Grievances Cell.
The petitioner admittedly has a stay order operating in his favour. This fact be informed by the respondent to the Public Grievances Cell who may not pass any order till the disposal of the appeal before the ATMCD/ interim order being varied. No further orders are called for in this petition. Petition disposed of.
