The petitioner has challenged the ex parte order dated 26th August, 2013 passed by the Authority under the Minimum Wages Act. 2.

Learned counsel for the respondent has no objection to the ex parte order being set aside and the matter being remanded to the Authority for fresh consideration after considering the defence of the petitioner. 3.

The ex parte order dated 26th August, 2013 is set aside and the matter is remanded back to the Authority under the Minimum Wages Act. The parties shall appear before the Authority under the Minimum Wages Act on 09th January, 2017 at 02:00 p.m. when the petitioner shall file its written statement.

The Authority shall, after completion of pleadings, record the evidence and thereafter, pass a fresh order in accordance with law. 4.

The petition along with pending application are disposed of. 5.

The amount deposited by the petitioner be refunded back to petitioner along with interest accrued thereon.
