This application is jointly preferred on behalf of the Plaintiffs and Defendants No. 1, 3 and 4 under Order XXIII Rule 3 read with Section 151 of CPC, 1908 for recording of settlement between the parties. 2.

Present suit is filed by the Plaintiffs inter alia seeking directions against the Defendants for removal of unauthorised structure built by them over the suit land and to pay damages. During the pendency of the suit, Plaintiffs and Defendants No. 1, 3 and 4 have settled their disputes and executed a Deed of Settlement dated 02.04.2025, which is placed on record and in light of this, it is prayed that the suit be disposed of. It is jointly stated by the parties that Defendant No. 2 is untraceable for the last 15 years and his right to file the written statement was also closed vide order dated 01.09.2017.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, the application is allowed recording the settlement between the parties.

The suit is decreed in terms of the settlement between the parties incorporated in the Settlement Deed dated 02.04.2025, which shall form part of the Decree and parties will remain bound by the terms of settlement. 6.
