IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(CRL) 1105/2015 AMIT ROY & ORS ..... Petitioners Through:

Mr. SuniL K. Kalra, Adv.

versus STATE & ANR ..... Respondents Through:

Mr.

Saleem Ahmed, Standing Counsel with Mr. Ajay Pratap Singh, Adv. along with SI Sachin Tomar, P.S. Pandav Nagar.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 26.05.2015 On the complaint of respondent no.2, present FIR 465/07 under Sections 420/468/471/120-B IPC was registered at police station Trilok Puri. Respondent no.2 has alleged in the FIR that petitioners had taken Rs.3 lacs from him on the pretext of getting a job and have, in fact, issued one fabricated appointment letter on behalf of M/s Tata Corporation Limited. Respondent no.2 is present in Court and submits that he has settled the matter with the petitioner no.1.

He also admits his signatures on the Settlement Deed dated 28th June, 2008, a photocopy whereof has been placed on record.

Respondent no.2 has no objection in case the FIR is quashed.

Keeping in mind that petitioner no.1 and respondent no.2 have settled

their disputes amicably on the terms and conditions as stipulated in the Settlement Deed, inasmuch as, as per respondent no.2 terms of settlement have been duly complied with by petitioner no.1, in my view, no fruitful purpose would be served in keeping the present FIR pending. Accordingly, in the interest of justice, FIR No. 465/2007 under Sections 420/468/471/120B IPC registered at police station Trilok Puri and the consequent proceedings emanating therefrom are quashed.

Writ petition is disposed of in the above terms. Dasti.

A.K. PATHAK, J.
