% 19.10.2016 CM Nos.38224-25/2016 Allowed subject to all just exceptions.
CM No.38223/2016 1.
There is a delay of 713 days in filing the appeal. The only ground for delay to be condoned in filing the appeal pleaded is that after the decision the applicant and his relatives were trying their level best for amicable resolution of the dispute with the respondent. 2.
We do not find this to be a sufficient cause to condone 713 days delay in filing the appeal.
3.
Vide impugned order dated September 23, 2014 petition filed by the appellant for restitution of conjugal rights has been dismissed. 4.
CM No.38223/2016 is therefore dismissed.
MAT.APP.(F.C.) 147/2016
MAT.APP.(F.C.) 147/2016 Since delay in filing the appeal has not been condoned, the appeal is dismissed as not maintainable.
