The petitioner is aggrieved by the fact that the revenue's demand, claiming outstanding amount of `41.45 crores, of which stay had been sought, was not granted. It is contended further that the revenue has not complied with the CIT (A)'s previous order to furnish details of amounts added back during the course of assessment proceedings.

We have heard learned counsel for the parties. The petitioner appears to have appealed to the CIT(A) against the assessment order. In the meanwhile, the petitioner claims to have filed rectification proceeding which was decided according to it in its absence and without a hearing.

In any event, having regard to the fact that the appeal is pending, the respondent CIT who is approached by the petitioner is directed to decide the application and give appropriate direction to the Assessing Officer (AO) within three weeks from today. Likewise, the AO is directed to furnish particulars required of him by the CIT(A) within the same period.

In the meanwhile, the respondents shall desist from taking coercive action The petition is disposed of in the above terms. Order dasti.
