Accordingly, the counsel for the petitioner seeks permission to withdraw the present petition but with liberty that in case any demand is raised by the respondent no. 3/Commissioner of Customs in future, then the petitioner reserves his right to initiate appropriate legal proceedings. 3.

Liberty as prayed for is granted.
