In view of the judgment dated December 23, 2016 the inevitable consequenceshas to be the RFA(OS)62/2016being allowed and RFA(OS) 69/2016 being dismissed.

We accordingly dispose of RFA(OS) 62/2016 setting aside the impugneddecree awardingdamages and costs againstthe appellantand in favour of the respondent.

The suit filed by the respondent is dismissed. 4.

As regards RFA(OS) 69/2016 wherein the respondent seeks enhancement of damages the same is dismissed. 5.
