None appears for the respondents despite service of notice. 2.

The petitioner has filed the present petition, inter alia, impugning the order dated 05.07.2016 (hereafter 'the impugned order') passed by the Central Information Commission (hereafter 'CIC'), whereby the petitioner's complaint made under Section 18 read with Section 20 of the Right to Information Act, 2005 has been rejected. 3.

The impugned order indicates that the only reason why the petitioner's complaint was rejected, was his absence on the date of hearing. The petitioner is present in person and states that he could not appear on the relevant date as he had a hearing before the Supreme Court. He has also filed his gate pass to establish the same.

It is also pointed out that the petitioner had prior to the said hearing, sent a communication to the CIC regarding his inability to attend the hearing on 05.07.2016.

It does not appear that the CIC had considered the petitioner's request for deferring the hearing.

In view of the above, the impugned order is set aside and the matter is remanded to the CIC to consider it afresh.

The petition is disposed of.
