% 25.11.2016 It appears that the appeal before the Debt Recovery Appellate Tribunal has been dismissed for non-prosecution by an order dated 16th September, 2016. The writ petition, filed on 14th September, 2016 has thus become infructuous.

The writ petition and application are dismissed as infructuous. However, this order will not prevent the petitioner from filing afresh writ petition, in case the appeal is restored.
